Terms of Service

Welcome to explorador. These terms govern your access to and use of the website at explorador.pt (the "service"). By creating an account or using the service you accept these terms. If you don't agree, don't use the service.

explorador is a trading name of Ovação Credível, Lda., company number 517743175, registered at Rua Direita, N.º 5, 3670-172 Vouzela, holder of Portuguese real-estate mediation licence AMI no. 26308 issued by IMPIC.

1. What the service is

explorador is a platform that monitors public Portuguese real-estate listings and lets you define search criteria. Based on those criteria, our automated agent sends messages to sellers on your behalf, typically with offers below asking. Seller replies are forwarded to you by email and, if you opt in, WhatsApp.

Monitoring listings and sending automated messages do not, on their own, constitute real-estate mediation or financial advice. These features only automate the initial contact. Unless you expressly engage the mediation service described below, any negotiation, viewing, promissory contract or deed is solely your responsibility.

We carry out real-estate mediation under licence AMI no. 26308. If you want us to represent you in a negotiation or purchase, that service is engaged separately under a written mediation contract, as required by Portuguese Law 15/2013 of 8 February. Without that signed contract we do not act as your agent and no mediation commission is owed to us.

2. Account and eligibility

• You must be at least 18 and legally able to enter contracts.
• You provide true, current and complete data when signing up.
• You're responsible for the security of your account.
• Notify us immediately of any unauthorized access.

3. Acceptable use

You may not:

• Use the service for unlawful purposes or in breach of the source platforms' terms.
• Send fraudulent, abusive, offensive or misleading messages via our agent.
• Try to circumvent technical limits, scrape at scale, or interfere with the infrastructure.
• Resell access or create multiple accounts to bypass limits.
• Use the service for unfair competition against explorador itself.

We may suspend or terminate accounts that violate these rules without refund.

4. Messages sent on your behalf

When you create a search you authorize us to message sellers on your behalf with offers based on your criteria. Messages identify you as the real interested party. You're responsible for content sent on your behalf — if a seller replies, you negotiate directly.

5. Third-party content

Listings, photos, descriptions and seller data shown are public content from third parties, collected from real-estate portals and websites. We don't own and aren't responsible for that content nor guarantee its accuracy, availability or legality. The logos and trademarks of the source platforms belong to their respective owners.

6. Availability and changes

We aim for 24/7 availability but don't guarantee it. We may suspend, change or discontinue features at any time, with reasonable notice for material changes.

7. Pricing

At the date of this version, the service is offered free of charge. We reserve the right to introduce paid plans in the future, with at least 30 days' notice.

8. Intellectual property

The code, design, brand, editorial content and aggregated database of explorador are our property. We grant you a personal, non-exclusive, non-transferable license to use the service per these terms.

9. Disclaimers and limitation of liability

The service is provided "as is", without express or implied warranties of fitness for a particular purpose, merchantability or error-free operation. We don't guarantee sellers will respond, accept offers, or that the final price will match our initial offer.

To the maximum extent permitted by law, our total liability to you for any cause related to the service is limited to €100 (one hundred euros). This limit doesn't apply in case of our wilful misconduct or gross negligence.

10. Indemnity

You agree to indemnify explorador against any losses, costs or expenses (including reasonable legal fees) arising from your breach of these terms or unlawful use of the service.

11. Termination

You may close your account anytime via /profile or by email. We may terminate your account in case of breach. Termination doesn't affect accrued rights or clauses that by their nature should survive.

12. Changes to terms

We may update these terms. Material changes are emailed to registered users at least 30 days in advance. Continued use after the effective date constitutes acceptance.

13. Governing law

These terms are governed by Portuguese law. Disputes fall under the jurisdiction of the courts of Lisbon, without prejudice to the mandatory rights of consumers resident in the EU.

You may also use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr or the competent Portuguese consumer arbitration centres.
